Scotland’s top prosecutor, Dorothy Bain KC, has implemented new safeguards regarding prosecution decisions for children accused of serious crimes, including rape. This follows concerns about the practice of “diversion from prosecution,” which allows cases to be referred to social services instead of going to trial. Bain announced a review in July 2023, acknowledging the “trauma experienced by victims and their loved ones.” Under the new policy, only senior crown counsel appointed by Bain will make decisions on diversion and referrals, ensuring better communication with victims.
