Democracy and the rule of law

The relationship between democracy and the rule of law is increasingly significant in today’s political climate, writes Richard Atkinson, vice president of the Law Society of England and Wales, highlighting that while democracy reflects the will of the people, the rule of law ensures that all individuals and authorities are bound by laws that protect human rights. He cites Lord Tom Bingham’s definition from 2010, which stresses that “all persons and authorities within the state… should be bound by and entitled to the benefit of laws publicly and prospectively promulgated.” Atkinson argues that both democracy and the rule of law are essential for a civilised society, stating: “The institution of democracy alone is not enough. Liberty can only flourish under the rule of law.” He concludes that these principles should complement each other to maintain balance and stability in governance.
